The definition of marijuana was modified to exclude hemp, which is defined as “the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers…whether growing or not, with a Delta-9 tetrahydrocannabinol ("THC") concentration of not more than 0.3 percent on a dry weight basis." Therefore, any cannabis plant or cannabis product with less than 0.3% Delta-9 THC on a dry weight basis is considered hemp and is excluded from the CSA. In other words, the 2018 Farm Bill explicitly made hemp and hemp products federally legal. But you still need to make sure that the hemp products are compliant with FDA regulations and state law.
